A guide to deposits, disputes and damages

LPS SCOTLAND one of the approved tenants deposit scheme administrators has launched a guide for landlords, tenants and inventory providers on disputes, damages on deposits. All three scheme administrators have signed up to this guidance.

The guide is designed to ensure a full understanding of how the adjudication works and tips and the guidelines that the scheme follows.

The starting point for all disputes is that the deposit remains the property of the tenant at all times. As such the deposit cannot be used to subside the outgoings of the landlord. A copy of the guide can be found here

One of the most important things to avoid disputes is a professionally prepared, detailed inventory that will list and itemise damages, defect as well as items that are of good condition. This used in connection with you exit check photos and notes should help avoid disputes
